The learned counsel for the petitioner submits that, the petitioner was employed from the Scheduled Tribe category. His tribe claim was invalidated. The petitioner filed Writ Petition No. 542 of 2014 before the Nagpur bench of this Court. The Division Bench partly allowed said writ petition under order dated 25.03.2015 and though confirmed invalidation, granted protection in the service.

The learned Assistant Government Pleader appears for the respondent No. 1.

This Court has in Writ Petition No. 903 of 2020 with other connected writ petitions under judgment and order dated 04th

2 wp 12088.21 May, 2021 held that once protection has been granted by the Court and that has become final, then the Government Resolution dated 21st December, 2019 would not operate against such persons.

In the light of the above, the impugned order placing the petitioner on supernumerary post is quashed and set aside. The writ petition is disposed of. No costs.
