For the reasons recorded separately, Criminal Appeal is hereby allowed. The judgment and order dated 30.06.2012 passed by the learned Additional Sessions Judge, Ahmedpur, District Latur in Sessions Case No.11/2011 (New) and Sessions Case No.8/2007 (old), is hereby quashed and set aside. The appellant/accused Kailash Shankar Navekar is acquitted of the offences punishable under sections 302, 376, 201 of the Indian Penal Code in Sessions Case No.11/2011 (New) and Sessions Case No.8/2007 (old). The accused be set at liberty forthwith, if he is not required in any other offence.
