Heard. By the present writ petition, the petitioner challenges the order dated 9.2.2023 passed below Exh. 42 in R.C.S.No. 279/2019 by the learned Civil Judge, Junior Division, Jamkhed, by which court commissioner was appointed. The court commissioner has submitted his report on 12.12.2023.

The present writ petition is filed after two and half years from the date of impugned order, appointing court commissioner. Thereafter, commissioner has also filed his report. The writ petition is thus filed belatedly.

Accordingly, the writ petition is dismissed. All contentions are left open to be adjudicated at the stage of appeal, if filed. ( ARUN R. PEDNEKER, J. ) ssc/
