The applicant wife, under this application, is seeking transfer of petition bearing No. A/134 of 2018 pending in Family Court, Aurngabad to the Court of concerned Civil Judge Senior Division at Ambejogai.

The aforesaid petition is fled by the respondent husband for getting divorce from the applicant wife. The applicant wife has also fled proceedings under the Prevention of Women from Domestic Violence Act in the Court of learned JMFC, Ambejogai bearing Cri. Misc. Application No. 194/2018. 4.

The learned counsel for the respondent husband strongly opposed the application. However, in the alternative

he submits that if the divorce petition of husband is transferred to the concerned court at Ambejogai then it be simultaneously heard with D.V. proceedings by keeping both the proceedings on one and the same dates.

As such, for the reasons stated in the application, the application is allowed and the Divorce Petition No. A/134/2018 pending with the Family Court, Aurangabad is hereby transferred to the Court of Civil Judge, Senior Division, Ambejogai. The respondent husband will be at liberty to make request for same date in respect of the D.V. proceedings as well as the present divorce petition to the concerned court. 6.

The application is accordingly disposed of.
