THE STATE OF MAHARASHTRA AND OTHERS ...

Advocate for Petitioners : Mr.Kulkarni Pramod A. AGP for Respondents/State: Mr.S.N. Morampalle. Respondent No.4 served.

...

CORAM : S.S. SHINDE & V.L. ACHLIYA, JJ.

Dated: MARCH 28, 2016 ...

Learned Counsel for the petitioners has tendered across the Bar copy of the application filed in the month of November, 2001 addressed to the respondent No.4. The same is taken on record and marked as "X" for identification purpose. Learned Counsel for the petitioners submits that, though the petitioners are raising grievance since 2001 for payment of rental compensation, the respondents / authorities have not redressed the said grievance. He further submits that the petitioners have given representations from time to time to respondent No.4. However, respondent

12558.15wp No.4 has not taken any decision on the said applications / representations.

We have heard learned Counsel for the petitioners and learned AGP for respondent - State authorities. This petition can be conveniently disposed of by giving directions to the respondents No.2 to 4 to take decision on the applications filed by the petitioners from time to time, as expeditiously as possible, if already not decided; however, within three months from today, on its own merits and after verifying the record maintained by office of respondent No.4. Needless to observe that, in case, respondents No.2 to 4 wish to hear the petitioners, they will be at liberty to do so. In case, decision is favourable to the petitioners, the respondents - authorities shall ensure that the payment so determined towards rental compensation is paid to the petitioners within six months from the date of taking such decision.

Petition stands disposed of on above terms.

Parties to act upon authenticated copy of this order.
