Ms. Sahiba Kaur h/f. Mr. D. S. Bagul, learned counsel for the applicant submits that there is delay of 01 day in filing the First Appeal and seeks condonation of the same.

For the reasons mentioned in the application, the Civil Application is allowed. The delay of 01 day caused in filing the First Appeal is hereby condoned.

Registry to register the First Appeal on the condition that the applicant shall remove all the office objections within four weeks from today.

Being aggrieved by the judgment and award dated 07.05.2025, passed by the Court of District Judge-2 and Ex-officio Member of M.A.C.T, Ambajogai in M.A.C.P. No.54 of 2022, the applicant has preferred present First Appeal.

The applicant submits that there are strong hopes of success in the First Appeal. That, during the pendency of the First Appeal, if execution and operation of the impugned judgment and award is not stayed, the very purpose of First Appeal shall stand frustrated. 3.
Considering this, execution and operation of the impugned judgment and award is stayed till returnable date on condition that the applicant deposits the entire payable decretal/award amount in this Court within a period of four weeks from today. 4.
Issue notice to the respondent, returnable on 07.11.2025. 5.
The matter be listed after service of notice is complete. In the meantime, the applicant shall take recourse to the provisions enumerated in Chapter II of the Bombay High Court Appellate Side Rules, corresponding to the stage and requirement of matter. [AJIT B. KADETHANKAR, J.] PRW
