DATE : 10th SEPTEMBER 2025 PER COURT :- CIVIL APPLICATION NO. 9697 OF 2025 This is an application for condonation of delay in filing the First Appeal. Office remark shows that the appeal is filed in time. Hence the civil application does not survive and disposed of accordingly. FIRST APPEAL NO. 2313 OF 2025 1.

Feeling aggrieved by the judgment and award dated 3rd May 2025, passed by the learned Member Motor Accident Claims Tribunal, Beed in M.A.C.P. No. 66 of 2020, the appellant has preferred this First Appeal. 2.

Issue notice to the respondent, returnable on 10.10.2025. 3.

The matter be listed after service of notice is complete. In the meantime, the appellant shall take recourse to the provisions enumerated in Chapter II of the Bombay High Court Appellate Side Rules,

The applicant submits that entire payable award of amount passed by the learned Tribunal shall be deposited within six weeks in this Court. The applicant further submits that there are strong hopes of success in the First Appeal. That, during the pendency of the First Appeal, if execution and operation of the impugned judgment and award is not stayed, the very purpose of First Appeal shall stand frustrate. With this, the applicant prays for stay to the execution and operation of the impugned judgment and award.

Considering this, execution and operation of the impugned judgment and award is stayed till returnable date on condition that the applicant deposits the entire payable decretal/award amount in this Court within a period of six weeks from today.
