The present Appeal from Order (Stamp) is filed alongwith application seeking condonation of delay against order passed below Exhibit-33 in Miscellaneous Civil Application No.191/2020 dated 28.03.2024 in Regular Civil Suit No.638/2019. 2.

The learned Advocate appearing for the respondent invites attention of this Court to the suit valuation clause in plaint of Regular Civil Suit No.638/2019. It appears that, suit is valued for Rs.2000/- for the purpose of Court fees and jurisdiction. Looking to the valuation of the suit, Appeal from Order would lie before District Judge.

In that view of the matter, Appeal from Order (Stamp) alongwith Civil Application is disposed of with liberty in favour of applicant to file appropriate proceeding before the learned District Judge.
