This petition is fled assailing the order dated 13.6.2019 passed by the 9th Jt. Civil Judge J.D., Nanded thereby rejecting petitioner's application for appointment of the Court Commissioner. One of the reasons why the application is rejected is non-completion of trial in the suit. The learned advocate for petitioner submits that, suit itself has been dismissed in default on 12.9.2022 and steps are being taken for its restoration.

In that view of the matter, present petition is disposed off with a liberty to petitioner to fle an application for appointment of the Court Commissioner, after recording of the evidence is completed. Writ petition is accordingly disposed off. No costs.
