Petitioners are aggrieved by the order passed by learned 9th Civil Judge, Senior Division, Aurangabad, below Exhibit-93 in Special Civil Suit No. 42/2022, thereby allowing the application filed by the plaintiff/respondent for exhibiting agreements to sale dated 24.11.1995 and 05.07.1997, styled as sale deeds.

Upon hearing the learned advocate for the petitioners and learned advocate for the respondent, this Court is of the opinion that it would not be desirable at this stage to go into the merits of the matter as the issues are subjudice before the Trial Bhagyawant Punde

{2} 928-WP-10222-2022 Court. Any opinion expressed by this Court would affect the decision of the suit. In that view of the matter, writ petition is disposed of with a clarification that the order impugned in the present petition shall not come in the way of the petitioners in challenging the admissibility, relevancy and proof of the agreements on merits.
