1] Heard learned counsel appearing for the parties. 2] The order issuing notice for final disposal was made on 18.11.2011 by this Court. Office report shows that till date, copies of the application have not been supplied by the applicant for the respondent no.2. The matter is of the year 2011. The applicant is said to be working as Talathi. The learned counsel for the applicant submits that the applicant has now retired.
Cr.Appln.4463/11 - 2 - 3] Looking to the fact that the offence was registered in the year 2011 and this Court had issued notice in the year 2011 and the further fact about conduct of the applicant in not even supplying copies for the respondent no.2, we make the following order.
4] Criminal application is not entertained and the same is rejected giving liberty in favour of the applicant to apply for discharge, if so advised, in case the chargesheet is filed before the trial Judge. No order as to costs.
