After having considered the grounds of objections raised in exception to the impugned judgment and the reasons as are assigned for withdrawal of the amount, I deem it appropriate to pass the following order, -

ORDER

i.

The applicant is permitted to withdraw 50% of the deposited amount on submitting an undertaking to the satisfaction of Registrar of BDV

BENCH AT AURANGABAD this court.

ii.

Balance 50% amount is permitted to be withdrawn subject to furnishing Bank guarantee of any nationalized or Scheduled Bank of equal amount.

iii.
