In First Appeal No.1267 of 2024, a pursis is tendered on record by the respondents. It is marked at Exh.X. 2.

As per the pursis, respondent No.4 Balaji Vasant Shinge, who was unmarried is no more and his heirs are already on record in the form of remaining claimants. Respondent Nos.5 and 6 got married and their marital names are required to be brought on record. Leave is granted to carry out the amendment to both parties. Instead of deleting respondent

No.4, the formal amendment showing his heirs is permitted to be carried out.

It is informed that in First Appeal No.1266 of 2024, respondent No.1E Uttam Nagnath Shinge bears incorrect surname. A photo copy of which is placed on record shows that surname is Kamble. In legal heir certificate also, it is recorded as Uttam Nagnath Shinge/Kamble. Leave is granted to correct the surname.

Civil Application for Withdrawal 4.

Leave is granted to amend the title clause as the same is permitted to be done in first appeals.

Applicants seek to withdraw amount of Rs.5,66,975/-. It is brought to my notice that in pursuance of the order of this Court dated 05.08.2023 passed in similarly situated matters, the claimants were permitted to receive 75% on furnishing undertaking. I propose to follow the same course. 6.

Civil application for withdrawal of amount is allowed partly permitting the applicants to receive 75% of the amount with accrued interest on furnishing undertaking.

7.

Balance amount shall be invested in any Nationalize Bank.
