Learned A.G.P. tenders copies of communication dated 16.10.2018, issued by the Director, Medical Education and Research, Mumbai, and another communication dated 22.10.2018, issued by the Joint Director, Medical Education and Research, Mumbai.

It is recorded in the communication dated 16.10.2018, that the eligibility condition incorporated in clause 4.3 of the Information Brochure prescribing that the candidates shall have passed their Nursing Degree/Diploma from an Institution situated in the State of Maharashtra and recognised by Maharashtra Nursing Council, Mumbai/Maharashtra University of Health Science, Nasik/ University situated in the State of Maharashtra, will not be pressed in service and candidatures of the candidates will be considered on the basis of their individual merit.

{2} wp991118.odt Similarly, in the communication dated 22.10.2018, it is recorded that, condition that the Diploma/Degree Course should be passed from an Institution situated in Maharashtra State recognized by Maharashtra Nursing Council, Mumbai, and approved by the Government of Maharashtra, incorporated in clause 4.2 of the Information Brochure, will not be pressed in service and the candidates fulfilling requisite qualification and norms would be considered for appointment.

In view of the communications placed on record, which are taken on record and marked "X-1" and "X-2", grievance raised by the petitioners, in the instant petition, does not survive.
