The petitioner belongs to Koli Mahadev-Scheduled Tribe and has been appointed in Zilla Parishad as against the vacancy prescribed for reserved category. The caste certificate issued to the petitioner is referred to the Scrutiny Committee i.e. respondent No.2-Scheduled Tribe Scrutiny Committee for verification and the said proposal is still pending with the said committee. As a result of failure to submit the caste validation certificate the employer has withheld the monthly salary payable to the petitioner.

In these circumstances this petition can be disposed of with directions to the respondent No.2 Scrutiny Committee to take the decision on the proposal in respect of validation of the Tribe certificate pending with the Scruitny Committee as expeditiously as possible, preferably within a period of eight months and it is accordingly directed.

In the meanwhile respondent Nos.3 to 5 are directed to release the monthly salary payable to the petitioner.

With the above directions the writ petition stands disposed of.
