The applicant is seeking pre-arrest bail in Crime No.48/2015 registered at Nanalpeth Police Station, Parbhani, for the offence punishable under Section 379 read with Section 34 of the Indian Penal Code.

According to applicant, there is no prima facie material available against her so as to implicate her in commission of crime in question, particularly in view of narration of factual situation of the scene of offence. Mr Warma, learned Counsel for the applicant would urge that the applicant will co-operate with investigation, if she is put to conditions.

With the assistance of learned Assistant Public Prosecutor, I have perused the investigation papers.

The offence is under investigation and at the initial stage. The modus adopted by the accused persons for commission of crime at various places and registration of number of crimes with same modus is required to be taken into account.

In view thereof, it will not be appropriate to order release of the applicant.
