Perused status report received from concerned Judge i.e. Joint Civil Judge, Senior Division, Bhusawal, in respect of the proceeding which is sought to be transferred in this petition i.e. Hindu Marriage Petition No.166 of 2019 filed under Section 9 of the Hindu Marriage Act for restitution of conjugal rights filed by respondent. However, the report shows that, the number of aforesaid proceeding is in fact Hindu Marriage Petition No. 167 of 2019 and it was filed by the present respondent. The report further indicates that, the respondent 1/2

995-MCA-230-2021 has already withdrawn the aforesaid proceeding on 3rd December, 2022 itself and thereafter filed fresh Hindu Marriage Petition No. 475 of 2022 for getting divorce. 3.

As such, it appears that the proceeding which is sought to be transferred in this application has already been withdrawn by the respondent and therefore, the present applicant stands disposed of as infructuous.
