Petition has been brought so as to seek a declaration that the reservation and which was made in the Draft Development Plan in the Tuljapur town, namely, Osmanabad-Latur-Naldurg 30 M ring road (having 12 M service road on each side) has lapsed. However, it appears to have been again clamped in the revised plan. Petitioner's Advocate submits that a fresh cause of action would accrue in the event this reservation is not taken to the logical end and conclusion during the Draft Development Plan. Therefore, he seeks leave to withdraw this Writ Petition with liberty to file a fresh Petition in the event the reservation is not carried to its logical end within the validity of the Draft Development Plan.

Writ Petition is allowed to be withdrawn with liberty as prayed for.
