IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO.8776 OF 2014 Shrikant Narendra Thakur PETITIONER

VERSUS

The State of Maharashtra and Others RESPONDENTS .......

Mr. Arun H. Koralkar, Advocate for the petitioner Mr. S. S. Dande, AGP for respondent - State Mr. M. S. Sonawane, Advocate for respondent No. 2 .......

[CORAM : SUNIL P. DESHMUKH AND R. G. AVACHAT, JJ.] DATE : 29 th APRIL, 2019 ORDER :

1.

The petition has been pending since 2014. The petition has been moved seeking restraint on adverse action being taken in respect of service of the petitioner, for want of caste validity certificate praying for protection till decision by the scrutiny committee.

2.

After hearing learned advocates for the appearing parties it transpires that the claim of the petitioner of validating his caste is still pending and no significant progress in the same is made during pendency of writ petition.

{2} wp8776-14 3.

Having regard to aforesaid, we deem it expedient that added respondent No. 4 proceeds with the process of verification of caste claim of the petitioner by following due procedure as early as possible and dispose of the same preferably within a period of six months from the date of receipt of writ of this order. Till such time, protection granted to the petitioner under the orders of this court shall continue to subsist. The protection would be subject to outcome of the claim of verification of caste of the petitioner and it would be for the authorities to take appropriate action accordingly. For said purpose, it would be expedient that the petitioner approaches scrutiny committee on 15th May, 2019.

4.

Writ petition stands disposed of.
