The learned Counsel for the petitioner submits that the petitioner has retired on 30.06.2008. He seeks benefit of the Government Resolution dated 30th October, 2009. The issue is no longer res integra. It has been held by this Court in case of Smt. Savitribai Narsayya Guddapa Vs. The State of Maharashtra and Ors. reported in 2014 (6) ALL MR 175 that those who retired in between 01.01.2006 to 26.02.2009, will also be entitled for the benefit of the said Government Resolution.

In light of the above, the respondent/State shall consider the case of the petitioner for payment of revised pension as per the Government Resolution dated 30th October, 2009 after verifying the factual matrix. The petitioner may submit such representation. If such representation is submitted, the same shall be decided as per the
