In this case, a challenge is to an order dated 02.06.2023 passed by the learned Tahsildar imposing of fine of Rs. 6,855/- and Rs. 1800/- towards royalty and rent. The learned Tahsildar by order 02.06.2023 imposed total fine of Rs. 68,655/- for carrying sand and for violation of Section 48 (7) (8) of the Maharashtra Land Revenue Code. 2.

A grievance is made that, the vehicle is not released only on the count that, the learned S.D.O. may take proceeding for imposing fine of Rs. 2,00,000/-. As on today, no order is passed by the learned S.D.O.

This Court finds that, the vehicle can be released on giving undertaking to the parties by giving copy to this Court. 4.

The vehicle of the petitioner shall be released on depositing of amount of Rs. 68,655/-. The petitioner would also file an undertaking that he would abide by the order if passed pursuant to the fresh action, if any, taken by the authorities. The vehicle shall not be used hereinafter for any illegal purpose in the similar activity without authorization. Till the action is finally disposed off he shall not transfer the vehicle. The said undertaking be filed before the authorities within a period of two (02) weeks from today by filing copy in this Court. 5.
