It is not in dispute that the earlier bail application, after filing of charge-sheet bearing Criminal Application No.3428 of 2015 was dismissed as withdrawn vide order dated 15th July 2015. According to Mr Tambe, the medical ground though was available at that time, was not canvassed for absence of information to that effect. 3.

Once the ground that was available on the date of withdrawal of earlier bail application was not in dispute, in my opinion, the present application is not maintainable, particularly in the background of report from the jail authorities.
