PER COURT :- The petitioner claims to belong to Kolimahadev, scheduled tribe and is employed as Vanrakshak in the office of respondent No.3 as against a seat reserved for ST category. The tribe certificate issued to the petitioner is referred to the Scrutiny Committee for verification and the proposal is stated to be pending. In the meanwhile, the employer has issued a notice on 6.8.2018 directing the petitioner to submit validation certificate and it has also been informed that his salary bill for August, 2018 stands withheld.
Under the circumstances, this petition can be disposed of by directing respondent No.2 to take decision on the proposal tendered by the petitioner for issuance of validation certificate, as expeditiously as possible and preferably within six months from today, in observance of the Rules prescribed in that behalf, after extending opportunity of hearing to the petitioner and it is accordingly directed. Respondents shall release salary of the petitioner and shall not take any action on account of his failure to submit validation certificate, subject to the decision of the scrutiny committee in that regard.
