This application is filed for seeking condonation of 247 days of delay in lodging the Second Appeal. Reasons explaining the delay are set out in paragraph Nos.3 to 5 of the Civil Application. 2.

Shri Kasliwal, learned Advocate opposes the application on the ground that the reasons set out do not justify the delay caused. 3.

Considering the above, the Civil Application is allowed. Delay of 247 days is condoned on the condition that the applicant - Aurangabad Municipal Corporation, shall deposit costs of Rs.1,000/- in this Court. Shri Kasliwal graciously submits that the said amount be donated to High Court Advocates' Bar Library, Aurangabad. As such, the above said amount be deposited with the High Court Advocates' Bar Library, Aurangabad within a period of four weeks from today. Upon depositing costs, the Second Appeal be registered. 4.

Needless to state, if this order is not complied with, the Civil Application shall stand rejected by recalling this order. ( RAVINDRA V. GHUGE, J. ) ...
