1032 WRIT PETITION NO. 10056 OF 2018 JOHN SHABAJI KHARAT

VERSUS

THE STATE OF MAHARASHTRA AND OTHERS ...

Advocate for Petitioner : Miss. S.V. Salunke h/f Mr.V.D. Salunke AGP for Respondents:Mr. P.S. Patil ...

CORAM : R. M. BORDE & MANGESH S. PATIL, JJ.

Date: September 07, 2018 ...

PER COURT :- The petitioner is no way concerned with the Management of the bank, nor is presently an employee of the bank. It is within exclusive domain of the bank, whether to continue respondent No.5 beyond prescribed age of 60 years. It is, however, within the frame work of the relevant regulations, for the respondent bank to take appropriate decision. There are supervisory authorities like the Registrar of the Cooperative societies and the Reserve Bank to exercise control over the affairs of the bank. Since the petitioner does not have any locus to question the apprehended action of the respondent bank, the petition, in the present form, in exercise of extraordinary jurisdiction under article 226 of the Constitution of India need not be entertained.

Writ Petition is rejected.
