Learned Counsel for the Applicant submits that the investigation into the crime No. 155 of 2023 registered with Udgir Rural Police Station, Dist. Latur for the offence punishable under Sections 143, 147, 148, 149, 324, 506, 329 of IPC and Sections 4/25 of the Arms Act and Section 135 of the Maharashtra Police Act is completed. According to him, there is no evidence in order to show any overtact being committed by present Applicants in the crime.

Learned APP opposed the application and relied upon the statements of eye witnesses.

Prima facie perusal of the statements of eye witnesses do not show any specific statement against present Applicants of committing any overtact in the alleged incident. Since charge-sheet is filed, application stands allowed by confirming interim order dated 19th August, 2023.
