The learned counsel for the petitioner submits that, only show cause notice is issued on 27.11.2020, but the final order of penalty is not passed and unless final order of penalty is passed, the petitioner cannot file appeal.

The learned Assistant Government Pleader accepts notice for all respondents and submits that, authority would pass final order of penalty within a period of three (03) weeks from today. 3.

The said statement made by the learned A. G. P. is accepted. In case final order is passed, the petitioner is entitled for file an appeal and in case such an appeal is filed, the authority shall decide the same on its own merits.

In the light of the above, the writ petition is disposed of. No costs.
