Crime No. 432/21 is registered with Parner Police Station on 16th June, 2021 for the offences under section 323, 324, 326, 504, 506, 34 of the Indian Penal Code ( for short "IPC). It is alleged that applicant No.1 had assaulted by sickle on the head of son of complainant and applicant No. 2 used iron rod in assaulting injured which has resulted in fracture.

Cross F.I.R. has been registered vide CR No. 431/2021 with Parner Police Station which is first in point of time under section 323, 324, 504, 506, 34 IPC.

Learned Advocate for the applicant submits that applicants are young boys. They have no criminal antecedents. Their arrest would

916ABA1180-21 jeopardise their career. The applicant No.1 is appearing for entrance examination of Army. Applicant No.2 is preparing for pharmacy course. 4.

Learned A.P.P. submits overt act has been attributed to both the applicants. They have participated in the crime. Weapons which were used in the crime are required to be recovered. Injury certificate supports the complainant's version.

It is noted that there are cross cases. The applicants are young boys having no criminal antecedents. Considering the aforesaid circumstances, relief under section 438 Cr.P.C. can be granted to them. Hence, I pass the following order :-

O R D E R

i.

Anticipatory Bail Application No. 1180 of 2021 is allowed; ii.

In the event of arrest of the applicants in Crime No. 432 of 2021 registered with Parner Police Station, District Ahmednagar, the applicants be released on bail on executing PR bond in the sum of Rs. 25,000/- each, with one or more sureties in the like amount; iii.

The applicant shall attend the investigating officer on 8th, 9th and 10th December, 2021 between 11.00 a.m. to 1.00 noon and thereafter as and when called for till filing of the charge sheet. iv.
