PER COURT :- The petitioner is taking exception to the final voters list, published by the Election Officer, wherein, the name of the petitioner has been directed to be deleted, under a wrong presumption that, no proceedings are taken up for objecting to the rejection of the change report, in respect of the earlier term. It is pointed out that, the observation made is patently incorrect. The petitioner may have a very good case on merit. However, the mode is prescribed for objection to the elections of a a public trust registered under the Bombay public Trust Act, by taking recourse to the provisions of Sec. 22 of the BPT Act. In exercise of extraordinary jurisdiction under article 226 of the Constitution of India, no interference is called for.

Keeping option of the petitioner to avail of the remedies available in law open, at an appropriate stage, the writ petition stands disposed of. ( P.R. BORA, J. ) ( R. M. BORDE, J. ) vbd
