This petition has been filed seeking direction to learned Chief Judicial Magistrate,Nanded, to expedite hearing of R.C.C. No.738 of 2008 (old R.C.C. No.601 of 2008) and decide the same within a time frame.

We have perused the order passed by learned Chief Judicial Magistrate on application (Exh.505). Learned APP invited our attention to the observations made in paragraph 6 of the said order.

Directions of expediting hearing in respect of a particular case have been sought for. Those are not counter cases, i.e. arising out of one and the same FIR, for which present applicant is being prosecuted. Learned Chief Judicial Magistrate was, therefore, right in turning down the application (Exh.505) 5.

Since R.C.C. No.738 of 2008 is pretty old, we request learned Chief Judicial Magistrate to give priority in hearing of the said case and decide the same within a reasonable time and not later than eight months from the date of receipt of a copy of this order.

Needless to mention, he may pronounce the judgment in R.C.C. No.181 of 2008, if hearing of the said matter is completed in all respects.
