Heard learned Advocate for the petitioners and learned AGP for the respondent-State for some time. The learned AGP points out that there is remedy of filing appeal before the SubDivisional Officer. In view of the same, this Court is not inclined to entertain this writ petition.

At this stage, request is made by the learned Advocate for the petitioners that at least his vehicle be released, which is seized by the Authorities and same is lying idle without any use. Hence, following order :-

ORDER

(i) The writ petition is disposed off.

(ii) The petitioner is at liberty to file appeal before the

( 2 ) wp9289.24 learned Sub-Divisional Officer. If the appeal is filed within one month from today, same shall be disposed off within three months thereafter.

(iii) In the meantime, if the petitioners deposit amount of fine and penalty, which is stated to be Rs.2,26,000/- with the Authority, the vehicle shall be released, on such deposit.

(iv) The amount of fine deposited shall be subject to outcome of the appeal.
