Learned A.P.P. has strongly opposed for granting the bail. She reiterated the reasons given by this Court in paragraph no.5 of order dated 28th August, 2020, wherein the application for bail moved by the applicant herein was turned down.

There are no words to condemn the involvement of the applicant herein. The fact is however that he has been behind the bars for little over four and half years. All the accused in this case have already been granted bail. The charge is said to have not yet been framed. It is not known as to 1 / 2

916-BA-1239-21.odt when the trial will commence and come to it's logical end. The applicant must have been under suspension. Considering his involvement in the offence, he may not be reinstated in job.

In view of change in circumstances, viz. longer period behind the bars, all the accused having been enlarged on bail, charge has not been framed, the application is allowed in terms of following order :- The applicant be released, in connection with Crime No. 27 of 2016 registered with Mandavi Police Station, Nanded for the offences punishable under Sections 167, 171, 193, 197, 198, 201, 203, 213, 214, 218, 221, 420, 419, 467, 468, 471, 120(B) read with Section 34 of the Indian Penal Code, on executing P.R. bond in the sum of Rs.1,00,000/- (Rupees One Lakh) with one surety in the like amount. No cash security shall be accepted. The applicant shall report at the concerned police station once a week i.e. on Sunday between 12.00 noon and 01.00 p.m.
