IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO. 10625 OF 2019 YOGESH DILIP JAYPATRE

VERSUS

PANDHARINATH KALU VAISE AND OTHERS ...

Advocate for the Petitioner : Shri L. H. Kawale ...

CORAM : RAVINDRA V. GHUGE, J.

DATED : 27th AUGUST, 2019.

...

PER COURT :

1.

The petitioner / original plaintiff has made an unusual request in this matter. He submits that Regular Civil Suit No. 148/2018 has been filed by him and application Exhibit 5 seeking temporary injunction is pending. On account of some reasons, the said application is not being heard. Pleadings of the parties are complete.

2.

Since the petitioner had expressed an urgency in the matter, this petition was taken on the production board as it is not listed on the regular board.

3.

In view of the above, I find that it would be appropriate

p2-wp-10625-19.odt to allow the petitioner to approach the learned Trial Court and advance oral submissions on Exhibit 5, on or before 21/09/2019. Needless to state, all the parties would canvass their submissions on or before the said date. The Trial Court would thereafter proceed to pass appropriate orders on or before 19/10/2019.

4.

With the above directions, this petition is disposed off. (RAVINDRA V. GHUGE, J.) shp/-
