Heard learned Counsel for petitioner and learned A.G.P. for respondent Nos.1 and 2, State.

The present petition is directed against the order dated 28.07.2016 passed by the Collector, Jalgaon, whereby the N.A. permission granted vide order dated 20.01.2014 and sanctioned layout permission granted vide order dated 02.09.2014 came to be cancelled. 3.

Learned Counsel for the petitioner submits that pursuant to the N.A. permission dated 20.01.2014, the layout was sanctioned and out of the said layout, the petitioner had purchased three plots. It is further submitted that thereafter the Collector cancelled the N.A. permission without granting any opportunity of hearing to the petitioner.

I have gone through the order passed by the Collector and I find that before passing the impugned order, the petitioner was not heard and hence, there was violation of principle of natural justice. 5.

In view of the same and in order to grant an opportunity, I am inclined to allow the present petition by setting aside the order passed by the Collector.

In view thereof, the Writ Petition is partly allowed. The order dated 28.07.2016 passed by the Collector, Jalgaon, is quashed and set aside to the extent of the petitioner.

The Collector, Jalgaon, is directed to hear the petitioner and after granting an opportunity of hearing, pass an appropriate order within a period of three (3) months from today.
