O R D E R

(14 th DECEMBER, 2024) 1.

This appeal is placed before us in today's National Lok Adalat. Learned Advocate Mr. Pathan Sartaj Khan H. is present on behalf of Appellant Original Claimant. The learned Advocate Mr. Chaudhari is present on behalf of respondent No. 2, Insurance Company.

The learned Advocates for both the parties submit that they have amicably settled the lis and placed on record the terms of compromise. The compromise terms are marked as Article "X" for the purpose of identification.

Respondent No. 2 Insurance Company has already deposited the amount of compensation as per judgment and award passed by MACT, Osmanabad, in MACP No. 76 of 2012 and the Original Claimant has already withdrawn the compensation amount.

Now respondent No. 2 Insurance Company agreed to pay an amount of enhanced compensation of Rs. 2,50,000/- (Two Lakhs and Fifty Thousand Only) to the Original/Claimant, in addition to amount of compensation awarded by MACT, Osmanabad, within a period of 8 weeks from today, in terms of compromise before this National Lok Adalat. The aforesaid amount of enhanced compensation is to be withdrawn by the appellant/claimant without back reference to this Court and without filing any separate application, in terms of award passed by this National Lok Adalat, on its deposit. 5.

The Member, Motor Accidents Claims, Tribunal, Osmanabad be informed accordingly.

The Court fee refund certificate be issued as per the provisions under the Maharashtra Court Fees Act, 1959.

Award be drawn up accordingly.

8.

The First Appeal and the pending Civil Application if any, stand disposed of.
