Pursuant to our order dated 08.02.2023, the Municipal Corporation has filed a short affidavit dated 15.02.2023. In paragraph no.4, it is conceded that no charges are proved against the petitioner and he has been exonerated. It is also conceded that he has voluntarily retired from service on 04.08.2014. In paragraph no.5, it is stated that the pension is being paid to the petitioner and the retiral benefits would be paid within six months. 2.

The learned advocate for the petitioner confirms that pension is being paid to the petitioner. He further submits that after waiting for nine years and though he has been exonerated from the two enquiries that were initated against him, retiral benefits have not been paid. He prays for a

( 2 ) 901 wp 11563.21 direction that the said benefits alongwith admissible interest, be cleared within one month.

In view of the above, we direct that the respondent-corporation shall ensure that all the retiral benefits of the petitioner with admissible interest as per the provisions of law, would be paid to the petitioner on or before 31.05.2023. We would not entertain a request for extension of even a single day.
