Applicant is involved in Crime No. 58/2015 registered at Ardhapur Police Station, Tq. Ardhapur, Dist. Nanded, for the offences punishable under Sections 302, 307, 498-A r/w 34 of the Indian Penal Code.

Heard Mr Anand Patil (Indrale), learned counsel for the Applicant and Mr Mote, learned APP for respondent/State. Perused papers of investigation.

It is the case of prosecution that deceased Savita Lakhan Pawale was married before 5 years of the incident. Couple was blessed with a son Nilesh. Incident occurred on 20th May, 2015. At the time of incident, she was carrying pregnancy.

On 20th May, 2015 at around 11:00 AM, applicant asked Savita to bring Rs. 10,000/- from her maternal house. As she refused quarrel took place. It is alleged that applicant assaulted Savita, poured kerosene on her person and set her on fire. She sustained 54.5% burns. Medical Officer opined cause of death as Septicaemia due to burns. 5.

After the incident statement of victim was recorded. In her statement recorded on the same day Savita attributed specific role to the applicant/accused. The supplementary statement was recorded on 21st May, 2015. Both the statements are consistent making out prima facie involvement of the applicant in the commission of crime. 6.

In this premise and particularly considering the nature of offences, severity of punishment and modus operandi of the applicant this Court does not find it fit to enlarge the applicant on bail. Hence the following order -

ORDER

Criminal Application No. 4850 of 2015 stands rejected. [ INDIRA K. JAIN, J. ] sgp
