The Applicant points out that this Court by it's order dated 19.01.2015 delivered in Writ Petition No.4032/2014 had permitted the Respondent/ Employee to withdraw the amount deposited by the Petitioner in the Court subject to the condition that the Respondent/ Employee executes an indemnity bond to the satisfaction of the Registrar (Judicial) of the same amount.
The contention is that an inappropriate/ insufficient indemnity bond has been filed.
*2* 915.ca.12975.15 I find that this Court has observed in paragraph 10 of the order dated 19.01.2015 as under:- "10.
The respondent-employee is permitted to withdraw the amount deposited by the petitioner in this Court, subject to condition that the respondent-employee executes the indemnity bond to the satisfaction of the Registrar (Judicial) of the same amount."
Shri Bhadgaonkar, learned Advocate for the Employee, relies on his affidavit in reply and submits that he has executed the indemnity bond on Rs.100/- non judicial stamp paper. In the event, it is required that the said bond should be on Rs.200/- non judicial stamp paper, he is willing to furnish such bond.
Considering the contentions of the parties, I do not think that this Civil Application needs to be kept pending. The same is, therefore, disposed of with a direction that the Applicant and the Non-Applicant shall, either in person or through their Advocates, approach the Registrar (Judicial), Bombay High Court, Aurangabad on 10.02.2016 at about 2:30 pm. The Registrar (Judicial) shall look into the grievance of the parties and in the event, the bond is to be furnished on Rs.200/- non judicial stamp paper, he shall issue necessary direction to the Non Applicant. kps (RAVINDRA V.
