ORAL ORDER :

Heard Mr. Dr. Godbole, learned counsel for the applicant/petitioner. The submission is by way of proposed amendment, wherein the applicant/petitioner prayed for addition of one sentence, the tenor of the petition is not going to change but, it only furthers the case of the petitioner and the petitioner has placed on record all necessary facts. Only this submission which ought to have been stated in the petition namely, 'the petitioner belongs to Maratha and her category is S.E.B.C. (open)', remained to be incorporated in the petition and accordingly there would be a consequential

ca10103.19 minor correction in the prayer Clause. It is also submitted by Mr. Dr. Godbole, the learned counsel appearing for the applicant/petitioner that by the said amendment no prejudice is going to be caused to the respondents, as the petition is pending for the decision, on merits before this Court.

Heard Mr. Manezes, learned counsel for respondent Nos. 4 and 5 and the learned AGP, Mrs. Diggikar, for the respondent authorities. For the reasons stated in the application and in view of the submissions of learned counsel Mr. Godbole for the applicant/petitioner, the application is allowed. 3.

Necessary amendment be carried out within one week from today.

Applicant/Petitioner to carry out amendment forthwith.

Copies of the amended petition be served to the learned counsel appearing for respondents No. 4 & 5 as well as the learned AGP.

Civil Application is accordingly disposed of.
