VERSUS

SAHAKAR MITRA SHRI CHANDRAKANT HARI BADHE SIR URBAN CO OPERATIVE CREDIT SOCIETY LTD ...

Advocate for Petitioner : Shri Wani Girish V. AGP for Respondent 2 : Shri Kutti P.N.

CORAM : RAVINDRA V. GHUGE, J.

Dated: October 16, 2018 ...

PER COURT :- The petitioner seeks to challenge the recovery certificate issued under Section 101 of the Maharashtra Cooperative Societies Act directly in this Court, which is dated 13.8.2008.

I do not find that this petition can be entertained after a delay of 10 years, inasmuch, if the petitioner is aggrieved by the certificate under Section 101 of the said Act, he has a statutory remedy of approaching the Registrar / Revisional authority under Section 154(2A) of the said Act, if otherwise permissible after such a delay. This petition is, therefore, disposed off.
