A] ORDER IN CIVIL APPLICATION FOR WITHDRAWAL The present civil application is filed by wife, mother, one minor children and one major children, for withdrawal of the amount deposited by the Insurance Company in this Court.
The appeal is filed by the Insurance Company on the ground of quantum.
3] In view of the same, the present applicants are permitted to withdraw 50% amount of compensation as directed by this Court to the extent of proportion granted by the Tribunal along with interest accrued thereon till date on furnishing usual undertaking to the satisfaction of the Registrar [Judicial] of this court. Undertaking to be filed by major applicants only. Remaining amount be kept in FDR on yearly basis. Civil Application is disposed of accordingly. 4] In the event of any exigencies, liberty to the applicants to apply for fresh withdrawal.
B] ORDER IN CIVIL APPLICATION FOR DELAY The present Civil Application is filed to condone the delay of 30 days in filing the First Appeal. For the reasons stated in the Civil Application, the same is allowed. Delay is condoned. Appeal be registered. Civil Application is disposed of accordingly. C] ORDER IN CIVIL APPLICATION FOR STAY The applicant - Insurance Company has deposited entire award amount in this Court. The interim stay granted by this Court stands confirmed. Civil
Application is disposed of accordingly.
D] ORDER IN FIRST APPEAL First Appeal is admitted. On admission, Adv.A.R.Mate, learned counsel waives notice for respondent nos.1, 2 and 5.
