Learned counsel for the applicant submits that the applicant was under-trial prisoner for some period and, therefore, has already suffered imprisonment for 23 months.

However, taking into consideration the nature of the injuries received by the wife of the present applicant, as detailed in the impugned judgment, without making any comment on the merit of the case, the present application is dismissed with liberty to the present
