The applicant, who is an employee of the Bank, is booked for the offence punishable under section 306 read with sec. 34 of the Indian Penal Code, vide C.R. No.I-170 of 2015, registered with police station, Ambad, District Jalna. The allegations against the applicant are that he has not released the part of the loan sanctioned to deceased and as such, the deceased has committed suicide. 3.

Perusal of the first information report and other investigation papers reflect that there was no knowledge to the present applicant that in case the amount is not disbursed, the deceased will commit

4865.15crapln -2suicide. Apart from above, it is noted that there was enough balance in the account of the deceased and he could have withdrawn the said amount. Further, it is revealed that the applicant has acted in tune with the procedure of the Bank.

In view of above, interim protection granted to the applicant vide order dated 9th September, 2015 deserves to be confirmed and it accordingly stands confirmed on the same terms and conditions. Criminal Application stands allowed in above terms. [ N.W. SAMBRE, J. ] Tupe/16.09.15
