We have heard Mr. Devkate, the learned counsel for the petitioner.

Mr. Shelke, the learned counsel appears for the respondent No. 1 and submits that, the petitioner was issued with the provisional assessment bill. Objection was also invited from the petitioner. The petitioner raised its objection by filing its say. Hearing was also given to the petitioner and now assessing officer will pass final order within a period of two (02) weeks from today.

Mr. Shelke, the learned counsel further submits that, the petitioner has remedy against the final order under the statute. 4.

In the light of the above, no further orders are required to be passed by this Court. The writ petition accordingly is disposed of. No costs.

The learned counsel for the petitioner submits that, the petitioner has deposited an amount of Rs. 4,00,000/- (Rs. Four Lacs only) pursuant to the orders of this Court. The respondent No. 1 is allowed to withdraw the said amount. The said withdrawal of the amount would be subject to the rights and contentions of the parties and in the event some liability is fastened against the petitioner under the said final order, the said amount be adjusted.
