Heard the learned Counsel. The learned Counsel, on instructions, prays for withdrawal of the petition, with liberty to approach the learned Industrial Court by filing the complaint. It is submitted that this is being an alternate remedy available to the petitioner, the petitioner may be permitted to avail this remedy for redressal of his grievance.

The petition is allowed to be withdrawn, with liberty as prayed for.

If the petitioner approaches the Judicial Forum, namely, the Industrial Court, the Forum may consider the aspect of delay on the backdrop of the petition being filed in this Court and, needless to say, on merits too.
