Applicants apprehend arrest in connection with Crime No. 80/2023 registered with Pimpalgaon Hareshwar Police Station, District Jalgaon for the offences punishable under Sections 307, 143, 147, 148, 149, 323, 324, 337, 427 and 188 of IPC, under Sections 4/25 of Arms Act and under Section 37(1) of Maharashtra Police Act. 2.
The first information report indicates that an incident had occurred
on 15/04/2023 at 8.00 am at village Shindad wherein about 60 accused came to the spot with sticks, sickle, stones and bricks etc. and started causing damage to the property. It is alleged against the present applicants that they caused assault on the head of Chandrakant Patil with sickle and that he sustained injury in the said assault. 3.
Perusal of the police papers show that Chandrakant Patil sustained single injury to his forehead which is simple in nature. Similarly, the weapon of assault is blunt objects. Thus, the injury caused to Chandrakant cannot be attributed to the present applicants. It is not in dispute that co-accused are already enlarged on anticipatory bail. Hence the following order.
ORDER
(i) ABA No. 1342 of 2023 and ABA No. 1356 of 2023 are allowed.
(ii) In the event of arrest of applicants in connection with Crime No. 80/2023, registered with Pimpalgaon Hareshwar Police Station, Dist. Jalgaon for the offence punishable under Sections 307, 143, 147, 148, 149, 323, 324, 337, 427 and 188 of IPC, under Sections 4/25 of Arms Act and under Section 37(1) of Maharashtra Police Act, they shall be released on bail on furnishing PR Bond of Rs.15,000/- (Rupees Fifteen Thousand only) each with one solvent surety in the like amount.
(iii) They shall attend the concerned police station once in a week till the filing of the charge-sheet. (iv) They shall not contact the witnesses directly or
indirectly.
(v) They shall not interfere with the evidence in any manner whatsoever.
