Applicants in both the applications apprehend arrest in connection with Crime No. 0133/2023 registered with Excise Inspector, State Excide Department, Flying Squad, Nandurbar, Dist. Nandurbar for offences punishable under Sections 65-A, 65-E, 80, 81, 83, 98(2) and 108 of Maharashtra Prohibition Act. 2.

Learned counsel for the Applicants submits that coaccused who is similarly placed is granted anticipatory bail by this Court in Anticipatory Bail Application No. 1092/2023 by order dated 20.07.2023. He, therefore, seeks grant of bail to the Applicants on the ground of parity.

Learned APP opposed the applications.

Perusal of First Information Report as well as investigation papers indicate that the role alleged against present Applicants is similar to the co-accused who has been enlarged on anticipatory bail. This, Court, therefore, finds no reason to take different view. Hence, both the applications are allowed in terms of interim order.
