Though respondent Nos.2 to 7 are yet to be served, but they are not contesting parties as they were original defendants. The learned Counsel Mrs. Ansari has caused appearance on behalf of contesting respondent No. 1 i.e. the original plaintiff.

The application is for condonation of delay of only 18 days in filing second appeal. Though the application is opposed, but considering the short period of delay, it stands allowed in terms of prayer clause (B) and disposed of accordingly.
