It is an application for condonation of delay moved by the applicant/insurance company.

Heard Mr. Upadhye, learned counsel for applicant/insurance company, Mr. Tandale, learned counsel for respondent Nos.1 and 2. Respondent No.3 though duly served with notice, remained absent. There seems to be delay of 263 days in preferring the appeal. Mr. Tandale, learned counsel for respondent Nos.1 and 2 opposed to condone the delay.

Having regard to the nature of dispute between the parties and for the reasons stated in the application for condonation of delay,

The application is hereby allowed in terms of prayer clauses (A) and (B).
