ORDER

(9th December, 2023) 1.

Mr. M. R. Deshmukh, learned counsel for appellant/insurance company is present along with Mr. Dinesh Bankar, Ofcer of Insurance Company. Learned counsel Mr. A. C. Darandale is present for respondent No. 1.

The learned counsel for both the parties submit that they have amicably settled the lis and accordingly placed on record compromise terms duly signed by both the sides. The compromise terms are marked as Article "X" for the purpose of identifcation. fa198.22.odt

Appeal is disposed of in terms of compromise. 4.

Statement is made that entire amount of compensation has been deposited in this Court. Respondent is permitted to withdraw amount along with interest except amount of Rs. 41,000/- as agreed in the terms of compromise between the parties. Amount of Rs. 41,000/- out of the said amount is permitted to be withdrawn by the insurance company.

Court Fee Refund Certifcate be issued as per rules. 6.

Pending civil application, if any, does not survive and stands disposed of.
